North Carolina Roofing Rules: What Homeowners Should Know

North Carolina has fewer roofing rules than many states, but the ones it has matter to Waxhaw, NC homeowners. There is a license line at $40,000, a cancel window after a claim denial and a clear permit rule for re-roofs. Each one is covered below, with the law it comes from.

The Short Answer

Here is the whole page in five points.

  • No roofer license below $40,000. At $40,000 or more, the job needs a general contractor licensed by the state board.
  • Five business days after a denial. For contracts the law covers, you can cancel once your insurer says no, and nothing starts or gets paid before then.
  • Most re-roofs skip the permit. A like-for-like job on a house at $40,000 or less, with no more than 15% of the deck replaced, usually needs none.
  • Roofers don't run your claim. Only a licensed public adjuster may act on your claim for pay.
  • Roof grants stay on the coast. Union County homes don't qualify for the state's programs.

Then there's the roofer who offers to "take care of" your deductible. North Carolina has no law against that offer, but it is still a red flag: a pressure tactic that says more about how the roofer sells than how they build.

Who Can Legally Roof in NC

North Carolina has no license made just for roofers. Instead, roofing falls under the general contractor law. G.S. 87-1 defines a general contractor as anyone who takes on a project costing $40,000 or more. Below that amount, a roofer needs no state license to replace your roof. At or above it, the work must go to a contractor licensed by the North Carolina Licensing Board for General Contractors (NCLBGC).

The board's rules include a Roofing specialty classification, covering the installation, tear-off and repair of roofs and roof decks (21 NCAC 12A .0202). A board licensee also has to put its license number on contracts and bids (21 NCAC 12A .0501).

  • Ask about insurance on every job. Every roofer should be able to show proof of coverage.
  • On a $40,000-plus job, check the license with the board. The name on the license should match the company on your contract.

Paying Your Own Deductible

Your deductible is the part of a covered loss you agreed to pay yourself. Some states ban roofers from offering to waive or absorb it. North Carolina does not. Senate Bill 622, filed in 2023, would have barred roofers from offering to pay a homeowner's deductible, but it died in committee. The 2024 roofing law did add rebate rules, though those sections apply to insurers and insurance agents, not to roofers.

So the offer isn't against state law here, but treat it as a red flag anyway. A roofer who leads with it is selling urgency, and you're left wondering where that money comes from in the price. This site never offers help with a deductible, in any form.

Contract Cancellation, Explained

North Carolina added a homeowner protection in 2024. Session Law 2024-11 amended G.S. 14-401.13, and it applies to contracts for residential roof replacement or repair signed on or after October 1, 2024.

  1. If your insurer denies the claim, you get five business days after the denial to cancel the roofing contract.
  2. Until those five business days have passed, the roofer can't start the job or collect any payment.
  3. The exception is emergency work you acknowledged in writing as needed to stop further damage, such as a tarp after a limb comes through.
  4. A roofer who breaks the rule commits a Class 1 misdemeanor.

The new language sits inside the off-premises sales statute, which governs sellers who come to your door, so it protects you for contracts the law covers and may not reach every contract. That same statute already gives buyers three business days to cancel a door-to-door sale. If you cancel, do it in writing and keep a copy.

Mint Hill adds its own rule: door-to-door solicitors need a town permit and must wear it, so ask to see it.

Grants for Stronger Roofs

North Carolina does fund stronger roofs, but only along the coast. The FORTIFIED insurance credits the state describes apply to beach and coastal rating territories. The Strengthen Your Roof grants serve the Outer Banks and barrier islands, and the Strengthen Your Coastal Roof program, announced in July 2025, is limited to 18 coastal counties.

Union County is not part of any of them, so homes in Waxhaw and the nearby towns aren't eligible. For any discount tied to a new or stronger roof, ask your insurer what your own policy offers.

Local Permit Questions

In North Carolina, replacing an existing roof on a house usually doesn't need a building permit when the job costs $40,000 or less and no more than 15% of the roof deck is replaced. Bigger jobs, new roof area or rafter and truss repairs do need one. That reading comes from the Office of State Fire Marshal's guidance on G.S. 160D-1110(c).

When a permit is needed, the office depends on where the house sits:

  • Town of Waxhaw. Homes inside town limits go through Waxhaw's own building inspections office, (704) 843-2195.
  • The rest of Union County. Union County Building Code Enforcement, 704-283-3816, covers Mineral Springs, Marvin, Weddington, Wesley Chapel, NC, Indian Trail, Lake Park, NC, the Union County side of Stallings, and Waxhaw-address homes outside town limits.
  • Monroe, NC. The City of Monroe issues its own permits.
  • Mint Hill. Mecklenburg County Code Enforcement handles building permits by agreement with the town, 980-314-2633.
  • Matthews. Building permits in Mecklenburg County are handled by Mecklenburg County Code Enforcement.

In Matthews and Mint Hill, plan on a like-for-like swap, since Mecklenburg County words the exemption around like-grade material. Your roofer should confirm with the right office before work starts.

Questions on the Rules

Does a roofer need a license to replace my roof in North Carolina?

Only when the job costs $40,000 or more. At that point, the contractor must hold a general contractor license from the NCLBGC, which offers a Roofing specialty. For a smaller job, no state license is required, so ask for proof of insurance, written terms and references from homes like yours instead.

Can a roofer offer to pay my deductible in North Carolina?

Nothing in state law stops the offer. A 2023 bill would have, but it never made it out of committee. Even so, we suggest treating the offer as a warning sign. It is usually a way to rush a decision, and it leaves you unsure how the rest of the price was built.

Can I cancel my roofing contract if my claim is denied?

For roofing contracts the law covers and signed on or after October 1, 2024, yes. You have five business days after the denial to cancel, and the roofer can't start work or take payment during that time unless you signed off on emergency repairs in writing.

Do I need a permit to replace my roof in Waxhaw?
